NarrativeAt approximately 5:30 p.m. on December 30, 2009, Employee #1, a drapery installe r employed by Cemtex Inc. dba Cemak Window Coverings, which manufactures and ins talls window coverings, was working alone and making a cornice box window coveri ng using a table saw (Ryobi Brand BTS10S 120 V, 60 Hz, 4,800 rpm XX071974140). W hile he was cutting wood with the table saw, he temporarily lifted his safety gl asses, which were covered in wood dust, from his face in order to have a closer look at the work piece. A flying particle went into his right eye. The employee notified the manager of the injury who then offered medical attention. Instead, the employee decided to go home and rest. From his home, he was transported to C ounty USC Medical Hospital and admitted at 10:00 p.m. on the same day with injur y to the right eye. The hospital staff referred him to an eye specialist. Employ ee #1 was hospitalized for three days and received two eye surgeries in the hosp ital. The employer did not ensure that the employee used suitable eye protection from flying particles when work was performed.
